Terms and Conditions (GTC)

1. Scope

The following General Terms and Conditions (GTC) apply to all contracts concluded between the operator of the online shop and its customers. Differing conditions from the customer will not be recognized unless the operator of the online shop has expressly agreed to their validity in writing.

2. Contractual partner

3. Offer and conclusion of contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order. By clicking on the button in the online shop, the customer places a binding order for the goods contained in the shopping cart. The operator of the online shop will immediately confirm receipt of the customer's order by email.

3.2 The contract is only concluded when the order is dispatched by the operator of the online shop. The operator of the online shop reserves the right not to accept orders.

4. Prices and payment terms

4.1 When selling goods, a retention of title generally applies, whereby the seller (www.solarblech.shop) remains the owner of the goods until the price has been paid in full.

4.2 All prices in the online shop are stated in Euros (EUR) and include VAT.

4.3 The customer can choose between various payment options offered in the online shop. The operator of the online shop reserves the right to exclude certain payment methods.

4.4 Purchase on account – When purchasing on account, unless otherwise agreed, payment is due within 14 days of the invoice being issued.

5. Delivery conditions

5.1 The operator of the online shop delivers within the entire EU and DACH region.

5.2 Delivery is at the customer’s expense. The exact shipping costs are stated in the online shop.

5.3 The delivery time is usually 1-5 working days from the date of dispatch. Any different delivery times will be indicated in the online shop. Different delivery times to Switzerland.

5.4 The following conditions apply to the export of goods to Switzerland DAP (Delivered at Place): The buyer bears all costs and risks associated with the transport and customs clearance of the goods. These include, in particular, the costs of packaging, transport, insurance and customs clearance. The seller assumes no liability for any delays, damages or losses caused by transportation problems or customs issues. The buyer is responsible for compliance with all applicable regulations and laws associated with the export of the goods to Switzerland.

6. Right of withdrawal and return costs

6.1 The customer has a statutory right of withdrawal, which the operator of the online shop provides information about on the website.

6.2 In the event of a cancellation, the customer bears the direct costs of returning the goods.

7. Warranty and Liability

7.1 The operator of the online shop guarantees that the goods are free from material and manufacturing defects at the time of delivery.

7.2 The operator of the online shop is not liable for damage caused by slight negligence. This does not apply to damage to life, body and health or to damage,

which are based on an intentional or grossly negligent breach of duty by the operator of the online shop. Any liability of the operator of the online shop under the Product Liability Act remains unaffected.

8. Data protection

8.1 The operator of the online shop undertakes to comply with data protection regulations.

8.2 The customer's personal data will only be collected and used to the extent that this is necessary to process the contractual relationship and to process inquiries.

9. Severability clause

Should a provision of these General Terms and Conditions be or become ineffective, this will not affect the effectiveness of the remaining provisions. The invalid provision must be replaced by an effective provision that comes closest to the economic meaning and purpose of the invalid provision.

10. Applicable Law and Place of Jurisdiction

10.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

10.2 The place of jurisdiction for all disputes in the B2C area arising from or in connection with the contractual relationship is the competent court.

10.3 The place of jurisdiction for all disputes in the B2B area arising from or in connection with the contractual relationship is the District Court of St. Pölten.
